Sexual Assault & Battery Defense in Murfreesboro

Serious Defense for Serious Charges

In Tennessee, sexual battery is defined as the intentional touching of any person’s intimate parts or clothing covering them, if touching for sexual arousal or gratification, with a victim by a defendant by coercion or force, without the victim’s consent (and the defendant knows the victim did not consent), when the defendant knows the victim is mentally or physically incapacitated, and/or when the act is accomplished by fraud (TCA § 39-15-505).

An offense of aggravated sexual battery is unlawful sexual contact with a victim under any of the following circumstances:

  • Coercion or force and a weapon is present (or the victim reasonably believes a weapon is present)
  • Bodily injury is caused to the victim
  • One or more person aides the defendant
  • The victim is less than thirteen years old (TCA § 39-15-504)

Don’t Subject Yourself to Fines, Jail Time, Sex Offender Registration, & More!

The courts do not take sex crimes casually and those charged are usually put to trial with the full extent of the law. Under Tennessee law, a person convicted of sexual battery or aggravated sexual battery is facing felony convictions and can receive jail time, fines, community service, counseling, and/or probation.

In addition, you may be required to register on the Sex Offender Registry, which is a public database. Other consequences, besides the court-ordered penalties, can include loss of personal relationships with family and friends, limited employment opportunities (or job loss), and limited places to live.
